In recent years, the phenomenon of tourist rentals has generated intense debate in the legal and social sphere in Spain. These days, the Plenary of the Civil Chamber of the Supreme Court has ruled in two recent judgments (1.232/2024 and 1.233/2024, of October 3), addressing the validity of the 3/5 majority required to prohibit this type of rental.
This Supreme Court ruling addresses the need for a specific 3/5 majority in homeowners’ association meetings to approve a ban on tourist rentals in a building. This decision is based on protecting the rights of property owners and seeking a balance between the private use of property and the rules governing coexistence in residential communities.
The ruling establishes that, to implement restrictions on tourist rentals in a building, at least 60% of the owners must agree. This provides a safeguard for those who wish to continue using their properties for tourist purposes, preventing decisions that could harm the value of their investments and their freedom to use their properties.
The Supreme Court maintains that any regulation limiting previously acquired rights cannot be applied retroactively without adequate compensation. This means that the prohibitions cannot affect tourist rental contracts already established before the regulatory change.
The requirement of a three-fifths majority strengthens the protection of landlords’ rights, while the declaration of the law’s non-retroactivity guarantees the legal certainty of prior contracts. This ruling not only reflects a balanced approach between the interests of landlords and the community, but also highlights the need for a broader debate on the regulation of tourist rentals in an increasingly complex urban context.
This decision will contribute to a clearer and safer regulatory framework, promoting harmonious coexistence in communities and protecting the investments of property owners in the real estate sector.
